In this first episode, Frank Hicks, Ian Roberts and Declan Byrne discuss three recent decisions – two from the New South Wales Court of Appeal, one concerning the Security of Payment and the other the Home Building Act and the definition of “residential building work. The third is a decision of Justice Campbell which provides a good summary of the authorities and principles in respect of the fundamental concepts arising in claims for misleading and deceptive conduct by oral representations.
In the second part of the episode, Adele Carr and Frank Hicks are joined by Professor McNamara of the University of New South Wales law faculty. Professor McNamara has studied the criminalisation of everyday behaviours and the impact on the urban public spaces, and talks about how our behaviour is being impacted by the increasing use of surveillance and “control offences”.
Lastly, Ian Roberts talks about his marathon ride for charity over the January holidays over the beaches of the eastern seaboard.
